Refusing an injunction in M/s Stellar Information Technology Private Ltd v Rakesh Kumar & Ors, Delhi High Court recently held that employees cannot be prevented from using experience and knowledge gained during the course of employment. A covenant that seeks to restrain trade in the guise of a confidentiality clause must be held to be void.
