The Indonesian Corporate Counsel Association (ICCA) kicked off its monthly discussions this year with a group forum on the newly issued Supreme Court Regulation No. 13 (2016) regarding procedures in handling corporate crime cases.
In December 2016, the Supreme Court of the Republic of Indonesia issued a new regulation that sets out procedures for prosecuting corporate crime, especially relating to its enforcement.
Even though existing laws in Indonesia recognize corporate criminal liability, in practice corporations are rarely brought before the court. The ICCA notes that one of the primary reasons for this is that there is no clear guidance on how to prosecute a corporation.
