Film titles not protected

Madras High Court in a recent judgment held that the Copyright Act, 1957, by itself does not protect titles of films, books or songs, as the title of a work is distinct from the work itself that is protected under the act.

In the Lyca Productions & Anr v J Manimaran case, the plaintiff Manimaran claimed that he was producing a film with the Tamil title Karu (Foetus) and that he had registered the title with the Film and Television Producers Guild of South India in 2011. Manimaran submitted that Lyca Production was simultaneously producing a film titled Lyca’s Karu, which it had registered with the Tamil Film Producer Council in 2017.
