A recent judgment of the Hong Kong Court of Appeal on a former public television station general manager’s acceptance of secret payments means caution should be exercised against the limited scope of the “reasonable excuse” defence in facing bribery charges for accepting such payments in Hong Kong.

The former general manager of TVB, Stephen Chan Chi-wan, and his former assistant, Edthancy Tseng Pei-kun, faced bribery charges for receiving a secret payment of HK$112,000 for Chan’s performance on his television programme Be My Guest in a Hong Kong shopping mall.

Story_3_picOn 26 October, the Court of Appeal held in the case of HKSAR v Chan Chi-wan Stephen and Tseng Pei-kun that Chan and Tseng failed to establish the “reasonable excuse” defence.
