As foreign companies enforce their IP rights more aggressively in India, Indian companies are coming under attack. A mental battle has begun, with both sides deploying innovative strategies in an attempt to stand their ground. Raju Bist reports from Mumbai
Swedish furniture giant Ikea made news in May when it got government clearance for the largest single-brand foreign investment in India – a whopping ₹105 billion (US$1.7 billion). Four months later, it became the focus of the Indian law fraternity when it sent a legal team to initiate action against more than two dozen small businesses.
“Ikea’s legal team has started to restrict domestic traders from using deceptively similar marks by sending notices as well as injunctions,” confirms Jatin Trivedi, an advocate and attorney at YJ Trivedi & Co in Ahmedabad.
