PDS Legal has won a tax case for e-commerce company Flipkart in Allahabad High Court. Delhi partner Tarun Gulati and principal associate Kishore Kunal obtained an order from the court against Uttar Pradesh’s value added tax department (UP VAT), which withdrew around ₹498 million (US$7.5 million) in tax dues from Flipkart without duly issuing a notice to the company.
Justices Vinod Kumar Misra and Tarun Agarwala ordered the Deputy Commissioner of Commercial Tax in Noida to refund the entire amount with interest and also pay ₹200,000 to cover the company’s litigation fees.
